1. Introduction
Welcome to The Genie Transportation Services LLC (“we”, “our”, “us”). By booking and using our transportation services (“Services”), you agree to abide by these Terms and Conditions (“Terms”). Please read these Terms carefully before making any reservations or using our Services.
2. Reservation and Payment
2.1. Booking: All reservations for transportation services must be made in advance through our website, by phone, or via email. A booking confirmation will be sent to you after we receive your reservation.
2.2. Payment: Payment for Services is required in full at the time of booking, unless otherwise agreed upon. We accept payments via credit card. Your reservation is not confirmed until payment is received.
2.3. Cancellation Policy:
- Full Refund: If you cancel your reservation at least 48 hours before the scheduled service, you will receive a full refund.
- 75% Refund: If you cancel between 24 and 48 hours before the scheduled service, you will receive a 75% refund.
- 50% Refund: If you cancel between 6 and 24 hours before the scheduled service, you will receive a 50% refund.
- No Refund: If you cancel within 6 hours of the scheduled service, no refund will be issued.
2.4. Waiting Time:
For non-airport pickup locations, 15 minutes of waiting time is included at no additional charge. After 15 minutes, a charge of $10 for every 10 minutes will apply if the customer requests that we wait.
We may be unable to wait beyond this time, depending on our availability. If this occurs, the driver will proceed with other scheduled pickups, and the customer is responsible for making alternative arrangements.
For airport pickups, the following wait times are included:
- 60 minutes of wait time after the plane arrives at the gate for flights that do not require US customs clearance.
- 75 minutes of wait time after the plane arrives at the gate for flights that do require US customs clearance.
- Waiting time will be billed at $10 for every 10 minutes above and beyond the included wait time.
2.5. No-Show: In the event of a “no-show,” where the customer fails to be present at the agreed-upon pickup location at the scheduled time, the customer will be charged the full fare for the service.
3. Customer Responsibilities
3.1. Accurate Information: It is your responsibility to provide accurate details about the service, including pickup and drop-off locations, the number of passengers, and any special requirements. We are not liable for any delays or issues arising from inaccurate information provided.
3.2. Punctuality: Please ensure that you are ready at the agreed-upon pickup time. If you are late, additional charges may apply, and the total service time will not be extended.
3.3. Behavior: Passengers must act respectfully and appropriately while using our Services. We reserve the right to terminate the service without refund if passengers engage in behavior that is unsafe, disruptive, illegal, or inappropriate.
4. Vehicle Usage and Limitations
4.1. Vehicle Condition: We provide clean and well-maintained vehicles. Should you notice any defects or issues with the vehicle, please notify the driver immediately. We are not responsible for issues not reported during the service.
4.2. Alcohol and Drugs: Alcohol and drug consumption is prohibited in our vehicles.
4.3. Property Damage: Any damage to the vehicle, including spills, stains, or broken items, will result in an additional charge to cover repairs or cleaning. Customers may also be responsible for the cost of any necessary repairs.
4.4. Personal Items: We are not responsible for lost or stolen personal items during the trip. Please check the vehicle for any belongings before exiting.
5. Safety and Liability
5.1. Passenger Safety: Passengers must always wear seatbelts, where applicable, and follow all safety instructions from the driver during the ride. Car seats and booster seats are provided by The Genie Transportation Services LLC if requested in advance. It is the responsibility of the parent/guardian of the child to ensure that the car seat or booster seat is properly installed and that the child is properly secured in the car seat or booster. We are not responsible for any injury or harm resulting from improper installation or failure to secure the child properly.
5.2. Liability: While we take great care to provide safe and reliable transportation, we are not liable for any indirect or consequential damages arising from delays, cancellations, or any incidents that may occur during the transportation service.
5.3. Force Majeure: We are not responsible for any failure or delay in providing our Services due to unforeseen events beyond our control, including but not limited to weather conditions, road closures, accidents, or mechanical failures.
6. Pricing and Fees
- 6.1. Service Charges: Prices for transportation services are subject to change based on factors such as distance, duration, time of day, and special requirements (e.g., additional stops, late-night fees, etc.). The final price will be agreed upon at the time of booking.
7. Amendments and Changes
7.1. Changes to Bookings: Any changes to your reservation, including pickup time, location, or number of passengers, must be made at least 24 hours before the scheduled service. We will do our best to accommodate changes but cannot guarantee availability.
7.2. Service Interruptions: We reserve the right to alter or cancel a reservation if necessary due to reasons such as vehicle breakdowns or unforeseen emergencies. In such cases, we will provide you with a full refund or an alternative transportation arrangement.
8. Privacy Policy
- 8.1. Personal Information: We collect personal information (e.g., name, address, contact information) solely for the purpose of providing our Services. We will not share your personal information with third parties except as required by law or for operational purposes necessary to fulfill your service.
9. Audio/Video Recording Devices in the Vehicle
9.1. Surveillance: For the safety and security of our passengers and drivers, The Genie Transportation Services LLC may utilize audio and video recording devices in our vehicles. These devices are used to monitor the safety of the passengers and ensure compliance with our terms of service.
9.2. Consent: By using our transportation services, you consent to the use of audio and video recording devices in the vehicle. If you do not wish to be recorded, please notify us prior to your booking, and we will discuss alternative arrangements.
9.3. Privacy: All recordings made by the audio/video devices will be stored securely and used only for safety, security, and operational purposes. Recordings will not be shared with third parties unless required by law.
10. Grocery Stops
10.1. Available Upon Request: Grocery stops are available if requested at the time of booking. The cost for a grocery stop is $20, which includes a 20-minute stop at Publix.
10.2. Additional Time: Any stop exceeding 20 minutes will be billed at an additional charge of $10 for every 10 minutes or portion thereof, rounded up.
11. Stroller Rentals
11.1. Available Upon Request: Single and Double Baby Jogger Strollers are available for rent and must be requested at the time of booking. Each stroller comes with a parent console, rain cover, custom name sign, and a case of water.
11.2. Responsibility for Loss or Damage: In the event that a stroller or any of the provided items are lost, stolen, or damaged, the customer is responsible for up to $50 in replacement or repair costs.
11.3. Proper Use: The customer must ensure the proper operation of the stroller and accessories provided. The Genie Transportation Services LLC is not liable for any improper use of the stroller or its accessories.
11.4. Incident or Police Report: In the event a stroller is lost or stolen, the customer must provide The Genie Transportation Services LLC with a copy of an incident report or police report from a law enforcement agency or theme park security within 24 hours. If an incident or police report is not provided, the customer will be responsible for the full replacement cost of the items lost or damaged.
12. Use of Independent Contractors
12.1. Outsourcing of Services: The Genie Transportation Services LLC may, at times, outsource transportation services to third-party independent contractors. These contractors are not directly employed by us, but we ensure that they meet our standards for safety, reliability, and customer service.
12.2. Liability: While we aim to ensure high-quality service, The Genie Transportation Services LLC is not liable for any issues arising from the actions or omissions of third-party contractors. However, we will work to resolve any concerns or disputes that may arise during the use of outsourced services.
13. Limitation of Liability and Governance
13.1. Limitation of Liability: The Genie Transportation Services LLC will not be held liable for any indirect, incidental, special, or consequential damages, or for loss of profits, revenue, or data arising from the use of our services, even if we were advised of the possibility of such damages. Our total liability for any claims related to the services provided will be limited to the total amount paid by the customer for the specific service in question.
13.2. Force Majeure: We will not be held responsible for any failure or delay in the performance of our services due to events beyond our control, including but not limited to acts of God, natural disasters, weather conditions, road closures, or mechanical failure.
13.3. Governance: These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Orange County, Florida.
